Definido por la Ley Nacional de Relaciones Laborales y la Ley Taft Hartley como prácticas de discriminación, coacción e intimidación prohibidas para el trabajo y la administración. La administración no puede formar sindicatos de empresas o usar tácticas coactivas para poner freno a una organización sindicalista. Los sindicatos no pueden obligar a los trabajadores a unirse a organizaciones que no son de su elección.
